Can my attorney help expedite a disability appeal?

On Behalf of | Dec 14, 2018 | Social Security Disability |

Even when a Northeast Wisconsin resident has what could rightly be called a strong case to receive disability benefits from the Social Security Administration, they may wind up having their application for benefits denied at the initial stages.

Thus will begin a waiting game of weeks or months and, in some cases, even more than a year, for an applicant to get his or her application for benefits in front of an Administrative Law Judge authorized to review the application to see if benefits should be awarded. While the backdating of benefits is customary if it turns out an applicant wins his or her hearing, they are going to have to figure out how to manage on limited finances while they await a review.

Some might question what Northeast Wisconsin Social Security Disability attorneys can do in order to speed up this review process. To some extent, this is a fair question since a lot of the delay is process-driven and calls for a political solution at the federal level.

However, there are still certain techniques that an attorney may be able to try depending on the circumstances of one’s case. For instance, an attorney may be able to write what is called a dire need letter asking the Administration to expedite the case. If the Administration grants the request, then the person’s request for administrative review moves to the top of the stack.

As the name implies, a dire need letter has to be based on an applicant’s unique and emergency circumstances. For example, an attorney can assert a dire need based on the fact that his or her client is about to lose housing or important medical care.
